The Biden administration has launched a significant new immigration initiative aimed at helping immigrant spouses of U.S. citizens gain legal status and, ultimately, a path to citizenship. This program, known as “Parole in Place,” is a unique opportunity for many spouses who currently lack legal status to remain in the United States and apply for a green card. Announced by President Joe Biden in June, the policy has the potential to impact hundreds of thousands of families across the country.
According to estimates from the Department of Homeland Security, approximately 500,000 noncitizen spouses and 50,000 children could be eligible to apply for this program. For these families, the program provides a much-needed chance to avoid deportation and secure a more stable future. However, there is some concern that the program could face legal challenges or be affected by the outcome of the upcoming presidential election.
To be eligible for the program, applicants must demonstrate that their deportation would cause extreme hardship to their U.S. citizen spouse. This hardship could be financial, emotional, or involve other significant impacts that separation might bring. Additionally, applicants need to have been continuously present in the United States for at least 10 years and must have been married to a U.S. citizen by June 17, 2024. The application process requires a $580 fee and the submission of extensive supporting documents to prove the applicant’s residency and marriage.
Applicants with a disqualifying criminal history or those deemed a threat to national security or public safety are not eligible for the program. Once approved, participants will have three years to apply for permanent residency and can obtain work authorization during this period.
While many couples are excited about this opportunity, the program’s future remains uncertain. Former President Donald Trump has already vowed to prioritize mass deportations if re-elected, raising concerns among immigrant families. On the other hand, Vice President Kamala Harris has emphasized that fixing the broken immigration system is a top priority for the administration, advocating for comprehensive reform that includes strong border security and a path to citizenship for those who earn it.
